Terms of Service

These Terms of Sale (“Terms”) govern the purchase of digital image files and related products (“Products”) from Hunter Studio Limited (trading as Hyperreal) (“we,” “our,” or “us”) through Pixieset. By placing an order, you agree to these Terms.

1. Orders and Delivery

  • All digital image sales are final. Due to the nature of digital goods, refunds or exchanges are not available once files have been delivered.

  • Orders are processed through Pixieset. Digital files will be available for download once payment is complete.

  • It is your responsibility to download and back up your purchased files. We cannot guarantee storage or access indefinitely.

2. Pricing and Payment

  • Prices are displayed at checkout and may be subject to change without notice.

  • Payment is due at the time of purchase through the payment options provided by Pixieset.

3. Intellectual Property

  • All images are protected by copyright law and remain the intellectual property of Hunter Studio Limited.

  • Purchase grants you a license to use the images as outlined in the Digital Image License Agreement, but does not transfer copyright ownership.

4. License Terms

  • The purchase of images grants a non-exclusive, non-transferable license to the license holder, as defined in the Digital Image License Agreement.

  • Any unauthorized use, reproduction, or distribution of the images outside the scope of the license is strictly prohibited.

5. Limitation of Liability

  • We are not liable for any indirect, incidental, or consequential damages arising from your use of purchased images.

  • Our liability to you for any claim related to a purchase will not exceed the amount paid for the relevant images.

6. Governing Law

  • These Terms are governed by the laws of New Zealand. Any disputes will be subject to the jurisdiction of the New Zealand courts.

Digital Image License Agreement.

This Digital Image License Agreement (“Agreement”) applies to all digital images purchased from Hunter Studio Limited (trading as Hyperreal) (“Licensor”).

1. Grant of License

  • Upon full payment, the Licensor grants the purchaser (“Licensee”) a non-exclusive, non-transferable license to use the purchased digital images.

  • The license is granted in perpetuity and allows unlimited usage by the Licensee.

2. Permitted Uses

The Licensee may use the licensed images for:

  • Personal, commercial, editorial, and promotional purposes, including print, digital, web, advertising, and social media.

  • Creating derivative works, provided they remain consistent with this Agreement.

3. Restrictions

The Licensee may not:

  • Transfer, sell, sublicense, or otherwise assign the images to any third party.

  • Claim copyright ownership of the images.

  • Use the images in a defamatory, unlawful, or misleading manner.

4. Intellectual Property

  • All images remain the sole intellectual property of Hunter Studio Limited.

  • No copyright is transferred under this Agreement. Only the usage rights described above are granted.

5. Indemnification

The Licensee agrees to indemnify and hold harmless Hunter Studio Limited from any claims, damages, or liabilities arising from misuse of the images in violation of this Agreement.

6. Governing Law

This Agreement shall be governed by the laws of New Zealand.
